    Mission and history

    The CFTC was created in 1974 by the Commodity Futures Trading Commission Act, when most futures trading was in agriculture.[1] Its mission is to promote the integrity, resilience and vibrancy of US derivatives markets through sound regulation.[1] Michael S. Selig became its 16th chairman on December 22, 2025, after Senate confirmation on December 18.[5] He previously served as chief counsel of the SEC‘s Crypto Task Force.[6]

    Under current law, the CFTC can bring fraud and manipulation cases in spot digital asset commodity markets. It has no general statutory program to register or supervise the firms that run those markets.[2] In March 2026, it joined the SEC’s interpretation of how securities laws apply to crypto assets. It said it would administer the Commodity Exchange Act consistently with that interpretation.[7]

    Role under the CLARITY Act

    The House-passed bill would give the CFTC exclusive jurisdiction over digital commodity sales on or through CFTC-registered entities, including cash or spot markets.[8] The CFTC would generally regulate digital commodity exchanges, brokers and dealers.[3] In the Senate, the Agriculture Committee advanced its own text, the Digital Commodity Intermediaries Act, 12-11 on January 29, 2026.[9][10] Selig welcomed that vote.[9]

    Rulemaking after the Senate vote

    In August 2026, Selig said the agency had crypto rule proposals ready and would proceed whether or not the bill passed.[11] After the Senate’s failed cloture vote on September 15, he wrote that Congress had failed to send a bill to the president, and that the CFTC and SEC have authority to set crypto market rules.[12][13] On October 5, 2026, the CFTC published an advance notice of proposed rulemaking on crypto asset transactions. It seeks comment on a new “crypto asset market” category of designated contract market.[4] Comments are due within 60 days of the notice’s publication in the Federal Register.[14] Selig said the goal is rules that prevent fraud such as FTX, rather than only prosecuting it afterwards.[15] He argued that failed platforms like FTX, BlockFi and Voyager Digital operated in the US under state money-transmitter licences, which he said were designed for payment firms, not financial markets.[16] Any rules adopted this way would rest on existing law and could be reversed by a future administration.[17] Follow developments in the CLARITY Act tracker.
